Terms and conditions   

General Terms and Conditions   

This website is run by Tom Laird Illustration. Where “we", "us" or "our" is used it refers to Tom Laird Illustration and “you” is you, my lovely customers.  

If you use or buy from this site, we consider that you to have accepted these terms and conditions. The latest version is always on this page and we can change and update them without notice to you.   

We reserve the right to refuse service to anyone, for any reason, at any time.   

All artwork, commissions, images and the contents of this site and their copyright are the property of Tom Laird Illustration unless stated and cannot be used or reproduced without permission from us. 
 

Commissions 

Although I will ask if you are happy for me to use commission images for marketing use on my website, Instagram feed etc. the copyright of the image is the property of Tom Laird Illustration.    

Commissions are a custom-made piece of work, so if you want to make a minor change to what has been agreed, please get in touch as soon as you can to see if this is possible. If the commission has started and you want to change the image used, or make significant changes an added fee may apply.  

Therefore, the first discussions are so important as this is your opportunity to ask any questions you have about your commission as I want it to be right for you.  

If you need to cancel refunds will be given within 2 weeks of notice, however the amount you’ll get will depend on what stage the commission is at and the following rules will apply:  

Commission has been agreed and paid for but work has not started - 85% of the commission fee will be refunded.  

Work has started and is around halfway to completion - 50% will be refunded.    

Artwork is over halfway to completion, has been completed, digital proof has been sent, print has been ordered or printed - No refund.  
 

Online store terms  

Where we refer to an 'item' we are referring to a sole product or service available for purchase on this website, and we take all reasonable care to ensure item details displayed are correct and accurate as possible. This means that finished items may look very slightly different as they are displayed because screen colours are different from printed colours.   

Please also note framed images are purely for illustration purposes only.    

We can also discontinue items or change their prices without notice to you. 

If we don’t accept your order, it may be because, the item is out of stock, we can’t process your payment, there has been a pricing or product description error, there is an issue with our supplier or it may be something else, but we’ll let you know and try to find the best possible solution.    

When you place an order, you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us. Your order will only be accepted by us once your goods have been dispatched.  
 

Liability and indemnity  

We shall not be liable for any direct, special, indirect, or consequential or incidental damages including loss of profit or loss of opportunity because of the use of or the inability to use any items that have been ordered on this website. You agree to indemnify us at once and on demand, against all claims, liability, damages, costs, and expenses, including legal fees, arising out of any breach of any of our terms and conditions.  
 

Jurisdiction  

These terms and conditions shall be governed by English Law and are subject to the exclusive jurisdiction of the courts of England & Wales.  
 

Entire agreement  

These terms and conditions combined with our published Privacy Policy (see below) and Delivery and Returns policy make up the entire agreement between the parties and replace all preceding and contemporaneous agreements between you and us whether written or oral.  
 

General  

Should any part-term or term be found to be unenforceable then the rest of the terms and conditions shall continue to have full force and effect as if the invalidated term were not present.   

Should any delay or failure to follow our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure nor liable for any loss that you incur, howsoever caused.  
 

Delivery and Returns   

Processing  

During checkout, you may be presented with one or more options for delivery. Where an estimated schedule for delivery is provided, this is an estimate only and your items may be delayed in being received due to circumstances beyond our control but we will keep hypo advised. Orders placed on Fridays, Saturdays or Sundays may not be processed until the following Monday.  
 

UK Delivery  

To ensure my prints reach you in the best possible condition, they are packaged in sealed rigid cardboard tubes, small parcel boxes or hard backed envelopes.  
 

They are posted using Royal Mail 2nd Class. Please allow 1-3 weeks processing time, from United Kingdom. If you need it sooner, other options are available but these are paid options at extra cost and you should contact us to discuss.  
 

Delivery outside of the UK  

Prints are dispatched to you via Royal Mail International Standard, but due to the greater distances please allow 3-4 weeks for processing and packaging. This mailing option does not include a tracking number as global tracked services are significantly more expensive and I try to keep the costs to you as low as possible. Again, if it's needed sooner just contact me to find out about other options.  
 

Cancellation of orders  

Most of my artwork is printed to order, so if you have bought, but changed your mind, please get in touch as soon as possible because if the item has been shipped the Returns policy will apply. For commission cancellations please see the commissions section.  

Returns policy 

I only accept returns if the item is damaged. If you just change your mind, you can return the item but any postage cost to you will not be refunded and the item must be returned in perfect re-sellable as new condition. 

Commissions, or personalised items cannot be returned due to their custom-made nature.  
 

Privacy Policy 

It’s simple 

I value your data – it’s all about trust; simple. That’s why the information you supply will only be used for the required purpose, and not shared outside of Tom Laird Illustration where unnecessary.   

The data we collect 

Account registration - Information when registering for a user account. The fields marked on the form with the *asterisk is mandatory and this is the basic information needed to set up an account on my site. Anything beyond this is simply to provide you with the best service possible and your lovely artwork.    

Cookies and Tags - My website uses these small data files which are placed on the device you are viewing my site on. What these do is collect information about pages viewed, products bought and what you get up to on my site and that’s it. It allows me to make the site better and you will be asked when you visit for the first time if you want to accept or disable these. It’s entirely your call and you can easily delete cookies at any time of your choosing by deleting them in your browser of choice.  
 

GDPR (General Data Protection Regulation) It protects you, so you can ask for any information I hold on you, and can ask for it to be removed or amended. That’s it – just email me and tell me if you want to change anything. This policy is kept up to date when any new regulations come in, but if you have any questions just let me know.
